Any debt incurred by either spouse during the course of a legal marriage is an equal responsibility of both spouses. The final divorce decree judge does not have a contract with the original creditor. The contract goes back to origination. If both of you signed what the judge said, you both are going to be stuck with it. It's really a matter of knowing your spouse. It's sometimes better to get as many things paid off before a divorce as you can. In spite what you see on television, the majority of separations and divorces in this country are caused by money and credit. I have seen it too many times over the past 28 years. The deal between you and the creditor supersedes the divorce decree.
