What Is An Easement?

An easement is an agreement between parties. The agreement usually involves a piece of a land. There are different types of easements. Let's say you have a power easement. You own the property, but you are leasing a power company use of part of it for bearing their power lines. Although you own the ground, you are allowing them to use part of it. You could have an easement for access or anything you would like.


Are title companies the ones that institute the easements?

A lot of times easements are already of record, but we have to make sure that the buyer knows that they are there. Sometimes if you have a seller that is selling 10 acres, you might have to make sure that an easement is put in place. An easement deed can be drawn out by the title company.
